Defection: Declare Dogara’s seat vacant within 7 days or face legal action, PDP writes Speaker Gbajabiamila

The Bauchi State Chapter of the Peoples Democratic Party (PDP), written to the Speaker of the House Representatives, Femi Gbajabiamila, urging him to declare the seat of the former Speaker of the House, Yakubu Dogara, vacant for defecting to the All Progressives Congress.

NATIONAL ACCORD had reported that Dogara who represents Dass/Tafawa Balewa/Bogoro Federal Constituency in the House of Representatives, recently dumped the People’s Democratic Party for the All Progressives Congress.

In a letter of resignation from the PDP which he addressed to the Chairman of the PDP Bogoro ‘C’ Ward, Bogoro Local Government Area of Bauchi state dated 24th July, 2020, Dogara, said he was resigning his membership of the ruling party in the state because governor Bala Mohammed was making the same mistakes the former governor made which led to his defeat in the 2019 election in the state.

He raised six issues of unfulfillment of campaign promises, mismanagement of resources, lack of respect to elders and traditional rulers in the state, in his letter.

The letter which was written by S. Rabo Esq., J. S. Jihrin Esq., A. S. Idris Esq and H.S.Saraki Esq dated July 30th and submitted on August 6th. 

The letter was copied to the Minority Leader, Members representing Zaki and Gamawa federal constituencies in Bauchi state and obtained by our Correspondent in Bauchi.

The PDP prays that Yakubu Dogara, the member representing Dass/Tafawa Balewa/Bogoro Federal Constituency in the House of Representatives be removed.

The letter reads: “We write with esteemed compliments as legal representatives of the Peoples Democratic Party (PDP) herein referred to as our client to upon its instructions and authority and forward the subject of this correspondence for your attention and necessary action.

“In the light of this our client has briefed us that it has been formally notified by Hon Yakubu Dogara, the member representing Dass, Tafawa Balewa, Bogoro federal constituency in Bauchi State, that he has defected from PDP to All Progressives Congress (APC).

“It is against the background of the foregoing that we demand your invocation of the provisions of Section 68 (1) (g) and (2) of the 1999 Construction of the Federal Republic of Nigeria as amended by declaring his seat vacant, consequent upon his said defection within seven (7) working days of the receipt of this notice.”

The letter added that “this comes with the further notice that upon your refusal, failure or neglect to heed this demand, we shall proceed to commence legal action against you in a competent Court of law thereby bringing to the fore the import of the famous legal maxim that says: ‘product agit qui praecepto legis obtemperial’ i.e ‘he should act prudently who obeys the command of laws’ in the context of your pledge to uphold justice, the rule of law and the deepening of democratic processes as captured in your inaugural address as the Speaker of the 9th Assembly in the House of Representatives.”
